Mooney Law Wins Appeal on PennDOT License Suspension

Attorney Paul Royer won a significant license suspension appeal before the Pennsylvania Commonwealth Court.  The Mooney Law win will undoubtedly have implications on past and future cases involving license suspension for ‘prior offenses’ under the Motor Vehicle Code.

The Commonwealth Court of Pennsylvania recently published an opinion that reversed the lower court’s ruling that allowed PennDot to issue a license suspension for a second offense even though there had only been a single DUI occurrence. In this particular case, the defendant was given ARD, was removed from the program and pled guilty to the underlying DUI offense. Even though there was only one offense, PennDot sought to suspend her license as if she had committed a prior offense as well.
