The Pennsylvania Department of Labor & Industry has published and released the new Average Weekly Wage maximum for 2023. The average weekly wage sets the Total Temporary Disability and Total Partial Disability rates for workers’ compensation cases for the 2023 year. In other words, it establishes what weekly or biweekly benefits will be paid to injured workers who are out of work due to a work-related injury. Injured workers who are out of work due to a work-related injury do not receive 100% of their wages, but a percentage based on the average weekly wage established by the Department.

The new maximum average weekly wage has been set at $1,273.00 per week, an increase from $1,205.00 per week in 2022. It is important to understand the new rates are applicable for injuries that occur on or after January 1, 2023. The table that establishes disability rates will be published in the Pennsylvania Bulletin on December 17, 2022. We will provide additional information for injured workers when that is published.

Correct and proper calculations of an injured worker’s average weekly wage is critical in a case to be sure the injured workers is being paid the benefits they deserve based on their wages. Not only does average weekly wage impact weekly disability benefits, but also settlement amounts, since everything is based on the established disability rate.
