Most of us know that smoking cigarettes is bad for your health. For decades, tobacco companies sought ‘alternatives’ to lower health risks, provide the same effect as cigarettes, but keep profits soaring. In 2015, Juul was founded and marketed itself as the new alternative to cigarettes. E-Cigarettes were marketed as a ‘safe alternative’ although we now know they are far from safe, and in fact, can have and are having devastating health effects on users.
Even more dangerous, JUUL utilized marketing strategies that targeted teens through catchy social media ads and numerous flavors without any information or disclosure that JUUL contained the addictive nicotine. This will not be limited to just JUUL. Others may be liable as well.
Juul ‘pods’ contain more nicotine than competitors. Marketing efforts have targeted young people. The result is that many young Americans are now suffering from a nicotine addiction. Bit, it was marketed as a ‘safe alternative’. Not only did JUUL potentially not go far enough to prevent this, but they may have had reason to believe that it knowingly advertised to children and teens.
On September 6, 2019, the U.S. FDA and the Centers for Disease Control and Prevention produced a joint warning letter regarding “over 450 possible cases of lung illness associated with the use of e-cigarette products have been reported to CDC” Five possible deaths have been confirmed.
“Referring to your ENDS products as “99% safer” than cigarettes, “much safer” than cigarettes, “totally safe,” and “a safer alternative than smoking cigarettes” is particularly concerning because these statements were made directly to children in school. Our concern is amplified by the epidemic rate of increase in youth use of ENDS products, including JUUL’s products, and evidence that ENDS products contribute to youth use of, and addiction to, nicotine, to which youth are especially vulnerable.[“5]
